Saif-Kareena marriage 'haram': Darul Uloom

A discordant note in the wedding celebrations of actors Saif Ali Khan and Kareena Kapoor has been struck by the Darul Uloom which has declared that the marriage is invalid as per the Shariat.

Mufti Rashid Qasmi, a member of the seminary, said, "Islam permits only marriages between Muslim men and women. Marriages between Muslims and non-Muslims are un-Islamic.”

The Islamic ban on a Muslim man marrying a non Muslim is extended especially to Hindus, as verse 2.221 says, “Do not marry unbelieving women (idolaters), until they believe….Nor marry (your girls) to unbelievers until they believe”. This veto does not extend to Christians and Jews for they are not polytheists unlike Hindus.

Kareena Kapoor’s father Randhir is a Hindu while her mother Babita, a Sindhi has been a practicing Christian for many years.

Maulana Mohammed Rabe Hasan Nadwi, chairperson of the Muslim Personal Law Board, said in Lucknow, “Since Kareena Kapoor is a Hindu and has not converted to Islam the marriage is haram. In Islam, marriage is a
contract, which is not applicable in this case”.

Maulana Mufti Arif Qasmi of the seminary was quoted as saying, “If you believe in Islam, then you will marry a Muslim girl only. But since Saif has married a Hindu girl, he wouldn't be a believer in Islam. But in this case, he is expected to declare his religious belief.”

Kareena and Saif had a registered marriage in Mumbai on October 16. Unlike her mother-in-law Sharmila Tagore, Kapoor changed neither her name nor her religion to sign the wedding register.

It is noteworthy that the Special Marriage Act of 1954, allows marriages between people of any religion, subject to some conditions and does not require any religious or ceremonial rites for the marriage to be valid.

Shaista Ambar, president of the All India Muslim Women’s Personal Law Board said, “There is no clarity on whether a nikah took place. That would not have been possible without conversion to Islam which by itself is a long process.”

The Hindi film industry has seen many instances of conversions to Islam for the purpose of marriage with Dharmendra-Hema Malini and Mahesh Bhatt-Soni Razdan being two examples. Saif Ali Khan’s first wife Amrita Singh had also converted to Islam before the wedding.
