Whichever way it would have gone, the verdict in the Arushi-Hemraj murder case was bound to draw sharp reactions. Rajesh and Nupur Talwar have been awarded rigorous imprisonment for life and their supporters have termed it a travesty of justice, a verdict that was pre- decided. The additional sessions judge said as much when he quoted Thomas Reed Powell in his judgement saying “….judges have preferences for social policies as you and I”. The hypothesis of guilt was established by 26 points, among them a lack of spontaneity on the part of the mother and the fact that the accused had not clung to their deceased daughter’s body. The judgement also spoke of the need to temper an enthusiasm for `presumed innocence’ by the `pragmatic need to make criminal justice potent and realistic’. Some family members were of the view that the judgment was too lenient and hanging to death was a better option.
